Terms of Sale & Image Licence

These terms govern your use of SnapZilla's websites (snapzilla.co.uk and snapzillaphotos.co.uk) and any purchase of digital or physical photographic products. Please read them carefully before placing an order. By placing an order or downloading images, you agree to these terms.


1. About Us

SnapZilla Photos is operated by Ashleigh, trading as SnapZilla, based in Plymouth, Devon. We are a nightlife photography service operating across Plymouth venues.

2. Image Licence — Personal Use

When you purchase a digital image from SnapZilla, you are purchasing a non-exclusive, non-transferable, personal-use licence to use that image. This licence is granted for the following permitted uses:


2.1 PERMITTED USES (PERSONAL)

Displaying the image on your personal social media accounts (Instagram, Facebook, TikTok, etc.)

Printing the image for personal, non-commercial use (e.g. framing, gifts to family and friends)

Displaying the image on personal websites or devices

Sharing the image with friends and family for personal, non-commercial purposes


2.2 COMMERCIAL USE

Commercial use of any SnapZilla image requires a separate written licensing agreement negotiated in advance with SnapZilla. This includes, but is not limited to:

Use in advertising, marketing materials, or promotional content

Use on business websites, branded social media accounts, or press materials

Use in publications, editorial content, or broadcast media

2.3 PROHIBITED USES

You may not, under any circumstances:

Resell, sub-licence, or redistribute SnapZilla images to any third party

Screenshot, screen-record, or otherwise capture watermarked or preview images as a substitute for purchasing

Significantly crop, edit, filter, or alter images in a way that misrepresents the original work

Use images in any obscene, defamatory, unlawful, or immoral context

Incorporate images into trademarks, logos, or service marks without express written consent

Submit images to photography competitions or use them for any commercial gain without prior written agreement


2.4 SOCIAL MEDIA CREDIT

Where possible, we ask that you credit @snapzillaphotos when sharing images on social media. This is not a legal obligation for personal use, but it is appreciated and supports our work.


3. Ownership & Copyright

All photographs taken by SnapZilla photographers remain the intellectual property of SnapZilla at all times. Copyright is retained by SnapZilla regardless of whether an image has been purchased, downloaded, or shared.

Purchasing an image grants you a licence to use it as described above — it does not transfer ownership or copyright to you.

SnapZilla reserves the right to use any images taken at events for portfolio, marketing, website, social media, and other promotional purposes, unless you have submitted a specific written objection via sendhelp@snapzilla.co.uk.

All content on snapzilla.co.uk and snapzillaphotos.co.uk, including images, text, logos, and design elements, is protected by copyright. Unauthorised reproduction or distribution may result in civil or criminal action under the Copyright, Designs and Patents Act 1988.


4. Terms of Sale

4.1 ORDERS

All orders are subject to acceptance by SnapZilla. Receipt of an order confirmation does not guarantee acceptance. We reserve the right to cancel any order at our sole discretion, including where images cannot be identified, where payment cannot be verified, or where a technical error has occurred.


4.2 PRICING

All prices are displayed in pounds sterling (GBP) and are inclusive of any applicable taxes. We make every effort to ensure pricing is accurate; however, in the event of a pricing error, we reserve the right to cancel the order and offer a refund or the option to purchase at the correct price.


4.3 PAYMENT

Payment is processed securely via Pixieset's integrated payment platform. SnapZilla does not store or have access to your full payment card details. Financial information is used solely to process your order.


4.4 DIGITAL PRODUCTS — DELIVERY

Digital images are made available for download via your Pixieset account or the link provided at the time of purchase. Albums are typically processed and available within 48 hours of the event, though processing may take up to seven days during busy periods. SnapZilla is not liable for delays caused by technical issues outside of our control.


4.5 PHYSICAL PRODUCTS — DELIVERY

Where physical print products are ordered (via printzilla.uk or otherwise), they will be dispatched via Royal Mail or a comparable courier service. Estimated delivery times will be provided at checkout. SnapZilla is not responsible for packages that are lost, stolen, or delayed once they have been handed to the courier and a tracking number has been issued.


5. Returns & Refunds

Your statutory rights under the Consumer Rights Act 2015 are not affected by these terms.


5.1 DIGITAL PRODUCTS

Because digital images are made available for immediate download upon purchase, they are exempt from the 14-day cancellation right under the Consumer Contracts Regulations 2013 where you have expressly consented to immediate delivery and acknowledged that the right to cancel is lost upon download. We will make this clear at the point of purchase.

If a digital image is genuinely misidentified (i.e. the wrong person is in the image) or is defective, please contact us within 14 days at contact@snapzilla.co.uk and we will endeavour to resolve the issue.


5.2 PHYSICAL PRODUCTS

Physical products (prints, merchandise) may be returned or replaced within 14 days of receipt if:

The product is damaged in transit (please photograph the damage on arrival)

The wrong image has been printed due to an error on our part

Items must be returned in their original condition, freight prepaid. Shipping costs are non-refundable except where the fault lies with SnapZilla. Please allow up to three weeks for replacement orders.

Claims for missing items must be reported within 10 days of the expected delivery date.


5.3 NON-REFUNDABLE ITEMS

We are unable to offer refunds or replacements where:

You have changed your mind after downloading a digital image

Physical products have been intentionally damaged after receipt

An order was placed incorrectly (e.g. wrong event selected) — please check your order before completing purchase


6. Limitation of Liability

To the fullest extent permitted by applicable law, SnapZilla's liability in connection with any product or service shall not exceed the price paid for that product or service.

SnapZilla shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our websites, services, or products. This includes, but is not limited to, loss of income, loss of data, or losses arising from third-party claims.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited by law.


7. Privacy & Data Protection

SnapZilla is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.


7.1 WHAT WE COLLECT

When you place an order, we collect your name, email address, delivery address (for physical orders), and payment details (processed securely by our payment provider — we do not store full card details).


7.2 HOW WE USE YOUR DATA

To process and fulfil your order

To contact you regarding your order or enquiry

To send occasional updates about new albums or services (you can opt out at any time)


7.3 THIRD PARTIES

We share data with third parties only where necessary to fulfil your order, including our print lab and courier partners. These parties are contractually required to keep your information confidential. We do not sell or rent your personal data.


7.4 YOUR RIGHTS

You have the right to access, correct, or request deletion of your personal data. To exercise these rights, contact sendhelp@snapzilla.co.uk. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.


8. Website Use

All content on snapzilla.co.uk and snapzillaphotos.co.uk is provided for the purpose of browsing and purchasing photographic products. You may not use the websites to:

Reproduce, distribute, or commercially exploit any content without our written consent

Introduce malicious software or attempt to gain unauthorised access to our systems

Use automated tools (bots, scrapers) to harvest images or data from our websites

SnapZilla provides the websites on an 'as is' basis and makes no warranty that they will be uninterrupted, error-free, or free of viruses or other harmful components.


9. Changes to These Terms

We may update these terms from time to time. The most current version will always be published at snapzilla.co.uk/Licence. The date at the top of this document indicates when it was last updated. Continued use of our websites or services after changes are published constitutes acceptance of the updated terms.


10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
